Breakfast Hosts Terms and Conditions of The Brilliant Breakfast 2026 Campaign (“the Campaign”) Thank you very much for agreeing to take part in the Brilliant Breakfast Campaign. These terms and conditions are in place to make sure: everyone is being kept safe at events; that our funds are ethically sourced; that we are complying with our legal and regulatory duties; and that we are protecting the Trust’s good name. This is vital for us to be able to keep helping young people live, learn and earn long into the future. It also gives you the confidence that you are supporting a reputable organisation which puts people’s welfare at the heart of what we do.
By participating in the Campaign by hosting a breakfast, you agree to the following terms and conditions.
1. You agree to engage with and promote the Campaign in a way which, in our reasonable opinion, is appropriate in light of The King's Trust’s (“
KT”) role as a young person’s charity, and will not cause damage to our reputation or bring HM The King or any other member(s) or employee(s) of the Royal Household or KT into disrepute.
2. You will not participate in the Campaign to raise money for an organisation other than KT.
3. You may use The Brilliant Breakfast logo lockups and other assets as provided on the Campaign Funraisin page (the
“Assets”) (within the UK only) for the duration of the Campaign in order to promote the Campaign and your participation in it. However, you may not use the logos in a way that provides commercial benefit or otherwise attracts VAT: (www.gov.uk/guidance/sponsorship-and-vat-notice-70141) unless agreed in advance in writing with KT. You may only use the Assets (and the exact wording contained in the Assets) to describe the Campaign, and the work and the impact of KT.
4. All intellectual property owned and/or created by KT (including but not limited to the Assets) shall at all times remain the property of KT.
5. You understand that you are solely responsible for organising and managing the Brilliant Breakfast event. You acknowledge that it is your responsibility to participate in the Campaign in a way which protects the health and safety of everyone attending a Brilliant Breakfast. This includes following all laws and industry standards (if applicable) in relation to health and safety, any relevant Government guidance in force at the time of the event; and ensuring that all shared food items have been hygienically prepared and display appropriate allergy information. For the avoidance of doubt, KT has no liability for the health and safety of participants in the Campaign, save to the extent that personal injury is directly caused by its own respective negligence.
6. You will assess any risks which may occur due to the nature of any events held in connection with the Campaign and take reasonable steps to reduce and/or mitigate these risks. This should include, but not be limited to:
• Having procedures in place to respond to first aid and emergencies during the event;
• On arrival, briefing attendees about local arrangements, welfare facilities, accessibility and a named point of contact for reporting any issues or concerns;
• Ensuring that any allergies and dietary requirements are catered for and communicated to attendees;
• Ensuring that food is prepared and served by competent staff in accordance to applicable food hygiene and safety standards; and
• Ensuring that all injuries, incidents or ill-health cases during the event are reported and recorded. Serious reports involving emergency services or hospitalisation must be reported to KT.
7. You will report to us within 24 hours any accidents or incidents which occur at any event in connection the Campaign which are sufficiently serious that they may impact KT (including, but not limited to, where they may impact KT’s reputation).
8. You will ensure that, if you use sub-contractors, these sub-contractors are subject to reasonably diligent checks and you agree to be responsible for their conduct.
9. KT shall not be liable for any costs, claims, losses or damage which arises in connection with your participation in the Campaign, save for any liability that cannot be legally limited.
10. If you are participating in the Campaign as a commercial entity (not an individual), you shall have in place and maintain in force appropriate insurance with a reputable insurer for the duration of the Campaign, including but not limited to public liability insurance, to cover all risks normally covered by a comprehensive policy of insurance in respect of the carrying out of this Campaign and any events in connection with it.
11. If you are under the age of 18, you will ask permission of a parent or guardian before participating in the Campaign or donating money to KT.
12. You will pay to KT all the funds raised for KT through your participation in the Campaign within two months of the event being held.
13. You will ensure you comply with the requirements of the Disclosure & Barring Service, (or equivalent body) with regard to members of staff (and volunteers and other relevant persons where relevant) working with children under the age of eighteen, young people or vulnerable adults for any events held in connection with the Campaign.
14. Your fundraising activity will:
• have regard to the provisions the Privacy of Electronic Communications Regulations (PECR) 2003;
• be aimed at the public generally, and not targeted at specific individuals;
• not include unsolicited phone calls;
• not include: sending market materials without the permissions required under all relevant laws, regulations and applicable industry or regulatory codes policies and standards;
• not include further attempts to fundraise from an individual who has expressly asked not to receive requests of this kind;
• not attempt to imply that any person has a moral obligation to support the Campaign;
• comply with the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (https://www.asa.org.uk/codes-and-rulings/advertising-codes/non-broadcast-code.html)
15. You shall comply with the terms of Fundraising Regulator’s Code of Fundraising Practice (https://www.fundraisingregulator.org.uk/code) in connection with the Campaign. You will not carry out any behaviour which would be considered unreasonable behaviour by the Fundraising Regulator.
16. You will comply with all requirements of the Gambling Commission, details of which can be found here, for example, when organising raffles.
17. KT may send you Campaign merchandise. KT does not warrant that such merchandise shall be fit for any particular purpose and, as far as permitted by law, excludes all liability for any loss or damage caused in connection with any merchandise.
18. We will process your personal data in accordance with the privacy notice published on our website: Privacy Notice | Terms and conditions | The King's Trust. We will use the details you provide on registration to keep you informed about The Campaign, and, if you sign up to up to our mailing, to keep you informed about other KT events, fundraising appeals and ways to support our work. You can unsubscribe from any such mailings at any time.
19. You have a right to update your preferences, to see the information we hold about you, to ask us to change any of this information or to ask us to delete your data. To do so, please contact Data.Protection@kingstrust.org.uk.
20. You will treat the data of third parties in a manner which is compliant with all relevant law in relation to data protection.
21. You agree that we are committed to the eradication of modern slavery and child exploitation and you will comply with all relevant laws relating to modern slavery (including the Modern Slavery Act 2015). You will ensure that any contracts related to the Campaign contain wording which is equivalent to this clause. You will let us know immediately if there is any actual or suspected modern slavery in supply chains relating to the Campaign. You will retain any records relevant to this issue and allow us to see these on request. You warrant that you have not been convicted or involved in any investigation regarding modern slavery or child exploitation.
22. You and we shall keep in confidence any information of a confidential nature (“Confidential Information”) obtained under these terms and shall not use it or divulge it to any person without the written consent of the other.
23. You shall provide, as and when required, any information we reasonably require to allow us to assess that you have complied with these terms and conditions.
24. If you breach any of these terms, KT shall have the right to exclude your participation in the Campaign and require you to remove any public affiliation with us.
25. These terms and conditions shall be governed by English law and the courts of England and Wales shall have exclusive jurisdiction.
